Critically important enterprise status was created precisely so this wouldn’t happen to the companies the country cannot survive without, economically or municipally.<\/p>\n\n\n\n
It sounds like a dry bureaucratic formula, but behind it lies a very practical question: which employers have the right to keep part of their workforce at their jobs during mobilization instead of sending them to the recruitment center. Let’s break down what this status is, who gets it, and why it’s worth knowing about even for those who have never filed a single application with a ministry.<\/p>\n\n\n\n
A critically important enterprise is a company, institution, or organization whose activity the state has recognized as so significant for the economy, defense, or community life that the country would fare worse during the special period without it. The decision to grant the status is made by a central executive authority, another state body with nationwide jurisdiction, or a regional or Kyiv city military administration \u2014 depending on exactly what the enterprise does.<\/p>\n\n\n\n
The basic rules are set out in Cabinet of Ministers Resolution No. 76 of January 27, 2023, on the reservation of conscripts, while specific sectoral criteria are refined annually by the relevant ministries through their own orders. In the summer of 2026, this system was substantially overhauled by Resolution No. 862 of July 1, which changed the approach to both underlying resolutions \u2014 No. 76 and No. 692 \u2014 at once.<\/p>\n\n\n\n
The list of those who can, in principle, apply for the status is considerably wider than it might seem. It includes defense-industrial complex enterprises, aircraft manufacturing, and the space industry \u2014 where the criticality is obvious without further explanation. But alongside them, critical infrastructure consistently appears on the lists: energy, water supply, heating, waste removal, communications \u2014 everything a community simply cannot go without for even a few days. The list also includes manufacturers whose output goes toward the needs of the Armed Forces under long-term contracts, companies operating in three or more regions of the country at once, and the construction industry \u2014 because rebuilding roads, bridges, infrastructure facilities, and critical structures during wartime has also been recognized as a state priority.<\/p>\n\n\n\n
The difference is that for contract work with the Armed Forces, or for status granted on the basis of geographic reach, criticality is now tied to the term of the contract itself: as soon as the contract ends, so does the basis for the status \u2014 and along with it, the right to reservation.<\/p>\n\n\n\n
For an employer, critically important enterprise status is above all the ability to avoid halting production or a project because of a staffing gap at the worst possible moment. For an employee, it means an official reservation from mobilization for the duration of the employment contract \u2014 not a verbal agreement that guarantees nothing in an actual crisis moment. That’s the difference between a company that reliably fulfills its obligations to the state and its people, and one that depends on chance every time.<\/p>\n\n\n\n
